A proteção dos direitos relativos à propriedade industrial de inteligência artificial: reflexões nas legislações brasileira e estrangeira

Abstract

This article has as research problem the following question: Does the Industrial Property Law (Law 9.279/1996) cover the granting of patent and registration to products derived from autonomous acts of artificial intelligence? For the satisfaction of this question, the objective is firstly to analyze the concept of author listed by the Brazilian legislation. Then, a study is made comparing the result initially obtained with the reflections listed by foreign laws and the Copyright Law (9,610 / 1998). In the end, it appears that the concept of patent ownership and registration listed in the LPI does not meet criteria of distinction, unlike that proposed in copyright law, allowing a resignification and a paradigmatic renewal in the Brazilian legal system. For this, the deductive methodology and the technique of bibliographic research are adopted.
