Filtragem constitucional: uma concepção discursiva

Abstract

This assignment deals with the constitutional filtering institute, from the book by Paulo Ricardo Schier, but, searching for a new manner of using it, which would be, having as the starting point the Discursive Theory from Habermas. Through out this paper we tried to establish the bases of constitutionalism that are necessary in understanding the theme, as much as demonstrate how the social scene in this moment of rupture with modernity demands changes to be made in the development of constitutionalism. In the end, we tried to display how the constitutional filtering would take place within each constituted power.
