Um olhar da Lei 14.133/2021 sob o enfoque da inovação em licitações e contratações públicas

Abstract

This paper deals with the theme of innovation in public procurement with the publication of Law 14.133/2021, which deals with the law on bids, administrative contracts and agreements. The general objective of the work is to understand the innovations and improvements implemented in the new bidding law under the focus of innovation, mainly regarding the analysis of legislative innovations that will bring about significant changes in the public procurement environment. As specific objectives, the innovations that were presented in the bidding law will be identified and analyzed, a course proposal will be presented to train people in the face of the new bidding law, and a manual and presentation slide will be prepared for the course. The focus of the research is based on the qualitative and exploratory study of the legislative innovations brought about with the publication of Law 14.133/2021 that will regulate public procurement in place of Law 8.666/1993 under the focus of innovation. The analysis of Law 14.133/2021, as well as the prototype course to be created are products of studies in the area of public procurement related to the area of innovation applied to the public sector, especially with regard to the updating of laws, processes and routines within the public procurement environment. The prototype course highlighted can be taught in any government school or training institute for public procurement servers and operators. For the execution of the project, presentation slides, course presentation manual, video lesson on the proposed themes and the present course conclusion work were elaborated. The development, operation and importance of the course for all public managers, public employees, servers, suppliers and various operators in the area of public procurement was evidenced with the publication of Law 14.133/2021, specifically with regard to the primary objective of innovation in the bidding process. The need to train these actors in the implementation of the new law under the innovation approach is preeminent. The issue of encouraging innovation was raised as an objective expressly delimited in the new law. This fact consolidates the idea of Law 14.133/2021 to be a catalyst tool for innovation in the public sector, specifically with regard to various routines present in the public procurement environment. The analysis of Law 14.133/2021 and the prototype course created are primarily aimed at training all people who work directly or indirectly with public procurement, and can be recognized as a professional investment for allowing learning and exchange of experiences on the subject. Finally, it is worth mentioning that the analysis of the new Law 14.133/2021, as well as the proposed course prototype are important pedagogical contributions for all public procurement operators in Brazil, focusing on the instrumentalization of the innovative tools brought by Law 14.133/2021 seeking innovation in the acquisition of works, goods and services throughout the Brazilian public administration.
