Abstract

The Hydroelectric Power of Funil (UHE Funil) was built in the high part of the “Grande” river, close to the city of Lavras - MG. The first studies come from decade of 60, and the accomplishment of the Environmental Impact Studies and Report (EIARIMA) are concluded in the years of 1991/1992. The Installation License (LI) was granted in the year of 2000 and the commercial operation with an installed potency of 180 MW was initiated in the year of 2003. The previous Studies of the Environmental Impacts are a control and environmental planning instruments and elementary obligation in any public or private decision that can cause damage to the environment. In a complementary way, the Environmental Impacts Report (RIMA) should reflect the conclusions obtained in the EIA. It was aimed at in this research to analyze the whole documentation regarding to the EIA-RIMA to notice how the landscape in the influence area of the Hydroelectric Power of Funil (UHE-Funil) was considered inside of the legal and institutional aspects and administrative limitations related to the enterprise. The results allowed concluding that the landscape as far as in the Brazilian Constitution or in the environmental legislation is considered as an specific area inside of the protectionists and conservationist aspects, related to the public patrimony, historical, cultural and related to the landscape. It is also included in the legal treatment of the landscape, the several categories of conservation units as the Ecological Station, the National Park and the Natural Monument, among others.
