dc.description.abstractThis paper seeks to understand the relation between the right to education regarding children and adolescents with the legislative determination contained in Article 6 ofLaw 9.394/1996 –amended by Law 12.796/2013 –reduced from six to four years old the age from which there is mandatory registration of the child in an educational institution. Moreover, in addition to trace the legislative and constitutional developments on the topic under analysis, the paper attempts to understand the legal consequences for parents or guardians for the breach of this legal duty. Furthermore, it also addresses perspectives about homeschooling and the right to education.pt_BR

dc.description.resumoO artigo busca compreender a relação do direito à educação das crianças e adolescentes com a determinação legislativa contida no artigo 6º da Lei 9.394/1996, cuja redação, dada pela Lei 12.796/2013, reduziu de seis para quatro anos a idade a partir da qual existe obrigatoriedade de matrícula da criança em instituição de ensino. Ademais, para além de traçar a evolução legislativa e constitucional sobre o tema, intenta compreender as consequências jurídicas para os pais ou responsáveis pelo descumprimento deste dever jurídico. Aborda-se, também, perspectivas acerca do homeschooling e o direito à educação.pt_BR
